Letters of administration

If the deceased hasn’t left a will, you must still apply for a grant of probate as it allows you to deal with the estate but with no will you are applying for a ‘grant of letters of administration’. It is very similar to applying for a grant of probate as it is a document which confirms that you are the person, or people, entitled to deal with the deceased’s estate. The main difference is that you will be referred to as an ‘administrator’ as opposed to an ‘executor’. It will fall to a family member of the deceased to act as an administrator and apply for the letters of administration.
