A railway signalman who was injured when he tripped over debris on an unlit walkway has secured compensation.
He was taken to A&E after the accident. X-rays showed that he had fractured his finger and he was fitted with a splint. He was unable to work for seven weeks. Fortunately, he made a full recovery.
After he commenced a personal injury claim, he was examined by an independent medical expert. A report was prepared which detailed his injuries and the financial costs that had resulted.
He claimed that he and his colleagues had repeatedly raised concerns about the walkway but were told that it would not be cost-effective to install lighting. After he brought his claim, however, his employer admitted a breach of duty and, following negotiations, a settlement was agreed.
